General Terms and Conditions for Testing Services
Shiding Testing and Certification Technology Services (Dongguan) Co., Ltd. (hereinafter referred to as the "Company") provides technical services to individuals or organizations in need (hereinafter referred to as "Customers") in accordance with the terms and conditions set forth in this article. The terms and conditions, as part of the relevant testing contract, testing application form, etc., shall be subject to the terms and conditions of any offer, service, or derivative contractual relationship between the parties, unless otherwise specified in writing.
1.When customers apply for testing, they should fill out the testing service application form and submit it to our company.
2. Customers should clearly fill in service requirements in the testing application form, including but not limited to testing items and the testing methods they rely on. If the customer specifies a testing method, the applicability of the testing method is the responsibility of the customer; If the testing method is recommended by our company, we are responsible for selecting the applicable method and notifying the customer
3. The customer shall provide the company with suitable and appropriate samples and necessary information according to the testing requirements, and pay the agreed testing fees and other related expenses.
4. After receiving the samples and relevant information provided by the customer, our company will conduct timely inspections. If any errors, insufficient sample quantity, damaged samples, or necessary information are found, we will promptly inform the customer to supplement qualified samples and information. The service period will be recalculated from the time our company receives the supplemented samples and information.
5. Our company provides testing services based on the commissioned projects and requirements stated in the customer testing application form, and sends testing reports in the agreed manner.
6. If the customer requests a change in the testing service requirements during the testing process, a change request must be submitted, and our company will conduct a new contract review on the changed content
7. The sample may be damaged or destroyed during the testing process due to the requirements of the testing method, and our company shall not be held responsible for this
8.If the customer has no specific requirements for retaining the tested samples, the company will retain the samples according to internal management requirements based on the characteristics of the samples. For samples that have exceeded the retention period, the company has the right to destroy them on its own. If the customer requests to continue storing them, the customer will be responsible for the sample storage fee. If the customer requests a sample return, the relevant costs shall be borne by the customer themselves.
9. In order to provide customers with better services, the company has the right to authorize other third parties with corresponding qualifications and performance capabilities to fulfill all or part of the required terms.
10. If there is a testing project that needs to be subcontracted for testing, the company is responsible to the client for the subcontractor's work, except for subcontractors designated by the client or statutory management agencies.
11. Unless the company does conduct sampling testing and explicitly states this matter in the report, the data results on the company report or certificate are only responsible for the tested sample and do not provide any opinion on the same batch of products as the sample. In any case, the company's responsibility should not exceed the scope of the testing report issued by the company for the sample.
12. After receiving the official version of the test report, if the customer has any objections to the test data in the report, please submit them in writing to the company within fifteen days and attach the original test report. If no objection is raised within the deadline, it shall be deemed as agreement to the test results.
13.Under no circumstances shall the customer alter, tamper with, or damage the content and appearance of the company's certificates or reports. All test reports or certificates, in whole or in part, are copyrighted by the company.
14. The customer promises to pay the testing fees to the company in a timely and full manner according to the contract, and shall not withhold or delay payment of any amount for any reason such as disputes, cross claims, or offsetting payments with the company. If the customer terminates payment or fails to pay all or part of the amount due to the company for any reason, the company has the right to suspend all services and refuse to issue testing reports and any related materials until the customer pays all outstanding amounts owed to the company and their interest. The company shall not be liable for any breach of contract or losses arising therefrom
16. In the event that the company is unable to fulfill or complete its agreed obligations due to circumstances beyond its control, the company shall not be held responsible, including but not limited to the following situations: in the event of force majeure; When the customer is unable to fulfill their obligations as agreed; When the company fails to complete the testing service as agreed due to customer reasons, resulting in any loss or damage to the customer; When there are changes in relevant laws, regulations, and standards.
17. The adjustment of rights and obligations of both parties and the resolution of disputes shall be governed by the laws of the People's Republic of China.
18. These General Terms and Conditions are established in Chinese. In case of any translation differences, the Chinese version shall prevail.
