Strong Assistance | Updated, EU POPs Regulations Add UV-328 Restriction Requirements

On May 5, 2025, the European Commission adopted a revised draft of the POPs regulation, adding restrictions on UV-328.

Intermediate use and other specific exemptions

For the purpose of this article, point (b) of Article 4 (1) applies to substances, mixtures, or articles with UV-328 concentrations equal to or lower than 1mg/kg (0.0001% by mass).

2. As an exception, items containing UV-328 may be placed on the market and used in the following situations:

(a) Used in land motor vehicles, allowed until February 26, 2030;

(b) Mechanical separator used in blood collection tubes, allowed until February 26, 2030;

(c) The cellulose triacetate film used in polarizing films is allowed until February 26, 2030;

(d) Used in photographic paper, allowed until February 26, 2030;

(e) The spare parts of the following equipment, if they were originally produced using UV-328, are allowed to be used until the end of their service life or until 2044, whichever is earlier:

(i) Land motor vehicles;

(ii) Fixed industrial machinery used in agriculture, forestry, and construction;

(iii) LCD display devices used for analysis, measurement, control, monitoring, testing, production, and inspection, except for medical equipment;

(f) The spare parts of the following equipment, if already in use with UV-328 during production, are allowed to be used until the end of their service life:

(i) LCD displays in equipment that comply with Regulation (EU) 2017/745 and Regulation (EU) 2017/746;

(ii) LCD display devices used for analysis, measurement, control, testing, production, and inspection.

3. Articles containing UV-328 that have been used within the European Union before or on the expiration date of the relevant exemptions specified in paragraph 2 (a) to (f) may continue to be used

POPs is an abbreviation for Persistent Organic Pollutants in English, with the Chinese name being "Persistent Organic Pollutants". It is a type of natural or synthetic organic pollutant that has long-term residues, bioaccumulation, semi volatility, and high toxicity, and can migrate over long distances through various environmental media (atmosphere, water, organisms, etc.), posing serious risks to human health and the environment.

In November 2004, the European Union approved the Stockholm Convention on Persistent Organic Pollutants (POPs). Starting from May 20, 2004, EU Regulation (EC) No 850/2004 came into effect, which prohibits the intentional production, sale, and use of substances listed in the Convention. On June 25, 2019, the European Commission issued a new regulation (EU) 2019/1021 on persistent organic pollutants (POPs), replacing the previous (EC) No 850/2004. The new POPs regulation came into effect on July 15, 2019, while the old regulation was abolished.
